These are the terms and conditions (“Terms and Conditions”) upon which we supply Tickets and permit to entry to our Attraction.
1. DEFINITIONS
In these terms and conditions the following definitions shall apply:
Attraction: Foxy’s Adventure Golf, Penrith Golf Hub, Rehills, Penrith, Cumbria, CA11 0DR or any part of it;
Event Outside our Control: any act or event beyond our reasonable control, including without limitation epidemics of infectious diseases, war (whether declared or not), threat of war, strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
Ticket: A valid ticket allowing the holder entry to the Attraction.

2.2 When contacting us please provide as much information as possible in reference to your booking.
3. BOOKINGS
3.1 These Terms and Conditions apply whether you make a booking via our website, by email, post, telephone or in person.
3.2 You will submit your booking to us but this does not mean we have accepted it. Our acceptance of your booking will only occur when we send you a booking confirmation at which point a contract will come into existence between you and us.
3.3 We do not accept bookings from persons under the age of 18.
3.4 Tickets you purchase are for personal use and cannot be exchanged, transferred or sold on for profit, loaned or given away to or used by a third party. If you breach this condition, we will be entitled to refuse access to the Attraction and cancel the Tickets without compensation.
3.5 To prevent fraud, we may carry out checks or you may be asked to provide additional identification after your booking so we can verify your purchase as legitimate. If you refuse to provide us with the additional identification and/or we suspect fraud, we may cancel your booking and/or Tickets.
3.6 We will process your personal details in accordance with these Terms and Conditions and our Privacy Policy. You acknowledge that the processing of your personal information is necessary for us to perform our contract with you. We also reserve the right to use your personal details to contact you in relation to service information, including, but not limited to, information about changes to these Terms and Conditions.
3.7 You must inform us of any change of address, contact phone number or email address, both before and after receipt of the tickets. Our contact details are included in these Terms and Conditions. Our preferred method to contact you is email. You should take care to provide a current, valid email address and be aware that your email filter settings may treat our emails as spam or direct them to your junk folder.

3.9 If you are making the booking on behalf of others in your group, it is your responsibility to ensure that these additional players agree to these Terms and Conditions and are in receipt of all relevant information relating to the booking. We shall not be responsible if members of your group are unable to participate, as a result of you failing to provide them with all the relevant information.
4. DELIVERY
4.1 Tickets will be sent to you by email.
4.2 It is your responsibility to ensure that you have provided us with a valid email address when making your booking.
4.3 Tickets must either be printed or displayed on a digital device when arriving at Foxy’s. It is your responsibility to ensure you have access to the QR codes provided for use at the Attraction. We will not be responsible if you do not have the QR codes to play. No refunds will be given.
4.4 It is your responsibility to check your Tickets upon receipt and advise us promptly of any errors. Mistakes made when ordering cannot always be corrected and any corrections are discretionary and may attract a fee. Refunds are not available.
5. CANCELLATION, CHANGES AND REFUNDS
5.1 Unless specifically stated otherwise in these Terms and Conditions, refunds are not available in any circumstances. This does not affect your statutory rights as a consumer.
5.2 We reserve the right to vary the opening and closing dates and times of the Attraction and to close, remove or cancel all or any part of the events or facilities within the Attraction for any reason including, but not being limited to technical, health and safety and/or operational reasons or due to special events or private functions.
5.3 You should check that your booking is going ahead at the scheduled date and time as we can’t guarantee to inform you of any changes to or cancellation of your booking. We won’t be responsible for any costs you may incur for travel, accommodation, any other related goods or service or other compensation.
5.4 If we do cancel your booking or make significant changes to the Attraction, date, or session time, we will endeavour to inform you in advance by email using the email address you provided when making your booking. In urgent cases, we may attempt to contact you by telephone using the contact number you have provided when making your booking.
5.5 If we need to reschedule your booking you will be given the option of exchanging your tickets for a new date/time. Reschedule requests made within 24 hours of your booking will incur a £5 rebooking fee. Tickets for sessions that have a higher value will incur a cost that is equal to the difference in price. Refunds are not available.
5.6 If we cancel a booking you will be given the option of exchanging your tickets for a new date/time. If the alternative options are unsuitable you may be offered a refund. Please note that any administration and transaction fees are not refundable in these circumstances.
5.7 Bad weather will not close the facility unless it’s thunder & lighting or extreme frost that makes it unsafe to play. Foxy’s Adventure Golf staff will decide if the course is unsafe to play. No refunds are given for poor weather unless it’s unsafe as deemed above. Foxy’s Adventure Golf may offer another day & time in certain circumstances of bad weather but this is subject to availability.
6. EVENTS OUTSIDE OUR CONTROL
We cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by or you otherwise suffer any damage or loss as a result of an Event Outside of our Control.
7. ATTENDING THE ATTRACTION
7.1 Admission to the Attraction is subject to these Terms and Conditions. If you breach any of these Terms and Conditions you may be refused admission or removed from the Attraction without any right to a refund.
7.2 Whilst inside the Attraction, you must comply with any reasonable instructions given to you by our personnel or any third party instructed on our behalf.
7.3 You will need to comply with health and safety rules and any security requirements we have in place at the Attraction including, but not limited to, security searches for the safety of those attending the Attraction.
7.4 We reserve the right to refuse admission or remove you from the Attraction without any right to a refund in certain circumstances and these are likely to include if you have consumed alcohol or illegal substances before attending, are involved with abusive, threatening, drunken or other anti-social behaviour, or carry offensive weapons or illegal or prohibited substances or make unauthorised audio, video or photographic recordings.
7.5 The Attraction has steps and bespoke features. By attending the Attraction you accept that you have a duty to take reasonable steps to ensure your own safety, taking into account any personal medical conditions. Care and attention must be paid in the venue to avoid trips and falls
7.6 Persons aged under 14 years will not be permitted entry into the Attraction unless they are accompanied by a responsible adult.
7.7 Foxy’s Adventure Golf is open to guests of any age but children aged 14 and under require a supervising adult.
7.8 Foxy’s is played in groups of a maximum of 6 people per tee time slot.
7.9 Upon registering to book at the Attraction, you will be required to accept a health and safety waiver/disclaimer, including ensuring that information is provided to all players. By accepting these Terms and Conditions at the time of registration, you are confirming it is your responsibility to inform all players and confirm their acceptance of these Terms and Condition. If other players decide at any point after purchase they do not accept these Terms and Conditions, no refunds will be offered.
7.10 Please arrive 15 minutes before the time stated on your Ticket. Latecomers may not be admitted and no refund will be offered.
7.11 All items, belongings and other property brought into the Attraction by guests are at their own risk and we accept no liability for any loss or damage to such property. As such, we recommend that guests do not bring valuables to the Attraction.

9. GIFT CARDS
9.1 Your gift card is valid for 12 months from the date of purchase. Tickets must be booked and redeemed within this period.
9.2 Gift Cards are non-refundable.
9.3 The value of a Gift Card is redeemable against the face value of Tickets in your basket. If the value of your basket is higher than the value of your gift card you will need to pay the balance.
9.4 Should the value of your gift card exceed the amount in your basket the remaining balance is reduced accordingly on your gift card & is available to use again. No cash value, or change, will be given.
